1. Acceptance of Terms
By accessing or using SwiftKhata ("the Service"), operated by sidtechno.com ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
SwiftKhata is a cloud-based point-of-sale (POS) and enterprise resource planning (ERP) platform designed for businesses in Pakistan. The Service includes web-based software, optional desktop applications, and related support services.
3. Account Registration
To use the Service, you must register an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Free Trial
We offer a 10-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using the Service. Your data will be preserved during a reasonable grace period after the trial ends.
5. Subscription and Payment
The Service is offered on a monthly subscription basis. The current price is Rs 3,000 per month per store location. Warehouse locations are free. Payment is accepted via bank transfer. Your subscription is activated upon verification of payment by our team. Prices may change with 30 days advance notice.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to store or transmit any content that is illegal, harmful, threatening, abusive, or otherwise objectionable. You may not attempt to gain unauthorized access to the Service or its related systems.
7. Data Ownership
You retain all ownership rights to the data you enter into the Service. We do not claim any ownership over your business data, customer information, product catalogs, or transaction records. You may export your data at any time using the export features provided in the Service.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. The desktop application provides offline functionality to minimize disruption during connectivity issues.
9. Limitation of Liability
To the maximum extent permitted by law, SwiftKhata and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
10. Termination
Either party may terminate the subscription at any time. You may cancel your subscription by contacting our support team. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be available for export for a period of 30 days.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms are governed by the laws of Pakistan. Any disputes arising from these Terms or the Service will be resolved in the courts of Pakistan.
